  • My Monroe County Pistol Permit Story

    Just thought I would share my story of obtaining my pistol permit in Monroe County. I first want to say that Monroe County still as far as my knowledge only gives out Concealed Carry Permits and not the "sportsman" licenses which are administrative only restrictions would could lead to revocation of permit if not followed but no charges since it is not against the actual law because there is no such thing as a sportsman license in the law.

    Anyways I was issued my permit in Sept of 2009. I actually turned in my application in February I believe and immediately began researching the law to fight them when I read the packet of information that came with the application lol. Basically the law states they have 6 months to approve or deny your permit as long as a delay is not your fault (i.e. you forgot to get a reference to sign of or whatever). I knew that permits were not being done within that time frame and I actually submitted around the same time as someone else. I said that they should complain if they didn't get it in 6 months and they said it would cause a delay for complaining and I disagreed so we decided they would sit and wait until they got it and I would complain at 6 months to see who was right lol.

    Well 6 months and a day came around and I began email county representatives and got nowhere so I called the state police (violating article 400 NYS penal law by anyone is a misdemeanor) and as soon as I mentioned pistol permit they cut me off and told me I had to talk to the Monroe County Sheriffs department investigators and transferred me over.

    When I spoke to the Sheriff investigators they told me the 6 months started when it was turned into the Judge. I then asked then why did the law state it started when the application was turned into the appropriate authority and since I was only allowed to turn it into the county clerk wouldn't that make them the appropriate authority? The deputy then got on the defensive and asked why I needed it so bad and since he evaded my question I evaded his lol. Basically he told me my application was in the filing cabinet and they were still working on the applications turned in 2 months prior to my own.

    About a week later the investigators starting calling my references and me which went well and approximately a month later I had my permit. I ended up getting my permit about a month and a half faster by complaining then the person who did nothing.

    Since then I have heard that did get better and were issueing them within around 4 or 5 months but I believe they have gotten slow again but I can't confirm that.

    Current word is back up to a year -ish here in Monroe County.

    I got mine back in ... 2001. I was home from college - had just turned 21 a few months prior while I was away. Did all of my running around and got my signatures. Dropped it off and headed back to Florida where I was attending school (January 01). Got home in May and it was waiting for me. No idea when it actually showed up since my parents didn't pay any attention. But at worst it was less than four months and more likely well less than four months.

    Oh my do times change!!

      Side question: Does a permit holder have to be present in order to have a pistol added to their permit? I wanted to get a pistol added to my permit and my wife's permit at the gun show this weekend. I know the county clerk usually has people present to handle pistol purchases and transfers. My wife has no interest in attending the gun show so I was wondering if I can just bring her permit along with the appropriate paperwork and get the pistol added to her permit without her being there.

        That I do not know..I could only imagine that with the way the State has been heading, she'll need to be present..again i no nodda just an educated guess..but i would strongly suggest not even hoping someone here guesses right or wrong but to call your County peeps for a definitive answer..you could go through all that hassle assuming someone says it's fine, just to get hosed when you get to the actual point of adding it on hers. Only my 13 cents subtract 11..

          To be honest I have no idea. I can tell you that you might be able to in Monroe county because they do things different then the letter of the law in the benefit of the permit holder when it comes to amendments.

          Here is law in 400 talking about amendment and that license holder has to do it which would be wife not you.

          9. License: amendment. Elsewhere than in the city of New York, a
          person licensed to carry or possess a pistol or revolver may apply at
          any time to his or her licensing officer for amendment of his or her
          license to include one or more such weapons or to cancel weapons held
          under license.

            I think that's a no-go because you have to sign some paperwork stating that nothing has changed and you're still eligible to own a gun (or something to that effect).

                Not 100% sure, but I'd say highly unlikely. I wanted to have my wifes grandfathers added to my permit, he's in Madison and I'm in Monroe. It's been near impossible to do. He's 94 and won't be traveling here any time soon. There is a form from the country clerk that could be signed in the presence of a notary and used, but it's not worth the hassle at this point.

                  My permit took 9 months, 11 days from time of application until the little green card was in my hand. Turned in Jan 14, 2013. References were called in early June, just barely four months in. I though, ok, this should be a done deal shortly. I started calling the County Clerk at the 6 month mark as well, and was sent to a voicemail box almost every time. Shockingly, none of my messages were ever returned.

                  It arrived on a Tuesday, I bought my first handgun, a Glock 19, on Wednesday on my lunch break from work. Couldn't make the county clerk on Thursday at lunch as we had a shop meeting, so I went Friday at lunch, got amendment added. Went back to work and could barely contain my excitement to pick it up after work and stretch her out over the weekend. And for the first time ever, my NICS came back DELAY. AAAAAARRRRRRGGGGHHHH. MOTHER****ER!!!!!! That was one of the longest weekends of my life. The proceed came through on Monday afternoon.

                    did something happen between last purchase and the delay one?? how many longs/hands you got that were all no prob NICS?? very curious as to why all of a sudden you got the delay..I just buy guns online, call my guy with the serial numbers so he can begin then roll with the process of getting the ammends, I never once even thought of a delay, and I would be pissed cause I drive like 30 annoying kinda minutes to my Dealer then 30 back to the Clerk and so on..now I wonder, unless you got something on ya since your last one, it could even be some dumbass Peshitta from another state, or evading tollboths lol or you killed somebodys cat and they know..do share, unless it's private of course.

                      Every county must be different as far as adding a co-owner or spouse. My most recent amendment took 3 weeks in Dutchess County but I believe it was delayed due to the holidays. My prior amendment only took 2 weeks. In both cases I put my wife on as co-owner, once we were there together in person, once I submitted it all through the mail. I had to include a separate letter to the Pistol Permit department that I wanted to add my wife as co-owner in addition to 1 amendment form for each of us. Went through both times smooth sailing.

                      When I got my Pistol License in Dutchess in 2012 it took 10 months to the day to get it. I posted a full description on the other site back then and happy to copy it here if you want all the gory details. At the time I submitted paperwork, December 2011, there was a huge spike in applications for all the reasons you know. Took to October 2012 to get it. Good news is that as of yesterday, 1/6/2015, Dutchess is running about 2 months for an appointment for prints and then 4 to 6 weeks after to get the license. While still unacceptable from a 2A perspective time-frame is much better.

                        Absolutely nothing happened. Not sure what the delay was for. I always use my SS# on NICS too just to be sure. I had just had a NICS previous to that one about 3 or 4 weeks before if I remember right. I have never had a delay once except that one single time. I was effin pissed.

                              So my cousin turns he is last Feb. He calls yesterday to ask about it and was told he would be called back.

                              He gets called back today. The woman tells him she found his application on the judges desk and that she took it to him to sign.
                              He signed it right there and she's sending it back to the clerk.

                              Anyone ever hear of that happening?
