  • West Virginia vs. EPA

A new ruling that reigns in the bureaucratic state? I haven't read it yet, but so far it sounds like it limits the EPA's authority a bit. I'll have to dig into it to see if it has implications for the authority of other unelected agencies.

It has HUGE implications for ATF, basically stating that bureaucratic agencies "cannot make broad changes that affect entire industries without going through Congress". Google "chevron deference", which is the crux of the WVA vs EPA case and also the exact mechanism that ATF used to ban bump stocks, pistol braces, etc. This is going to result in a major smack down of the ATF's BS as of late.
