  • Please Read: NYF & Vertical Scope info

    I just wanted to bring some things to people's attention that may not have given this any thought about NYF. Since I learned of this buyout by vertical scope I decided to do looking and noticed that they have changed the privacy policy and the terms of service. The funny thing is I was never given any notice to this, not even a simple email letting me know .

    So I read the terms of service and decided I did not agree with having all my posts there being able to make money for a company backed by anti Gunners. My content would now be theirs to do with as they please and a company backed by anti Gunners does NOT have my trust or permission.

    Anyways I remember reading the old terms of service and Mike never made mention of posts becoming his property so all user generated content would therefore remain the creators.

    So in essence Vertical Scope just stole everyone's property and won't delete it. Remember all those posts deleted about grey areas, or from people angry right after SAFE Act ? Well those were all soft deleted...... What does that mean? Vertical Scope now has access to all those statements even the ones you meant as jokes that could make you look bad in a court of law.

    Here is their reply to my request to delete all my posts.

With respect to your posts, Mike (former owner) confirmed that all submissions made by users on NYfirearms.com were voluntarily submitted, the site had a license to the posts submitted and there were policies and practices in place against deleting posts on the website except where required by law. You would have been aware of these as a past moderator. Please see the link below for NYfirearms’ terms of use which state that all posters to NYfirearms.com provide VerticalScope with an irrevocable license to their posts (please see the link and bolded/underlined paragraph below).

    I made it clear in my request that I only logged on site and sent pm for purpose of proving my identity and that I did not consent to terms of service. My first PM included that information.

    Also what about everyone's posts in last that have not even been on site ( like me who used only to request deletion of posts). They have not used site since new rules but apparently that doesn't matter and they own your posts there to use as they see fit.


    I hope they only use it to make money and not use the posts hidden from view that could be incriminating to some!

    At this point I am looking at my options and am not going to give up!


    ETA: below is privacy policy from former NYF which clearly does not prevent deletion of posts, further it states if your information is to be used for new purposes outside that term you will be notified PRIOR to it being used in new way.

      LMFAO. So explain to me this, how is it that you agreed to have no recourse against VerticalScope for any misappropriation (actual or alleged, ha, ha) for posts made before VerticalScope was even a party to such agreement? Sounds like unenforceable BS to me. Has a familiar ring to it from other anti-gunners, huh. Where's Shooter anyway?

        Wow it's worse than I thought. I guess I will stop posting and stop using my login. The whole thing is describing really. You know what you post is public but for it to become someone else's property is absurd. Also when the websites changes hands I don't see how they don't make you agree to the new terms and conditions. Hell I get the prompt with everything else that is digital. I also think legally they have to delete anything posted before their take over upon individuals request.

          How can one request for everything one posted to be deleted?
          Can one legally do that under the old agreement?

                I want to see what usmc has to say.
                Otherwise I might mail them a written letter requesting the deletion of all my history and account.
                It would be nice to have a copy of the old agreement and a draft we all can fill out and send.

                  What if you do what I'll call a cgrutt from a couple years ago? How was that again, change your email and then not confirm it or something like that? I don't remember the details...

                      Would Hex have access to the previous user agreement? It sounds like he isn't really maintaining any loyalties to NYF.

                      Doesn't Google keep some sort of archive of web pages? Perhaps we could find the old user agreement there.

                              See exactly! Never said anything about keeping you posts if you don't want them too and specificly said they would notify you before using your info in the new way!

                              I will be working on some type of form letter, Mek get me that page if you have the cached one please.
