  • Brady Check

    I wanted to put some pistols on my permit at the gun show but found out that I needed to get a Brady check. I was told that I needed to fill out the paperwork and they would mail it in for me. I was told I would get a completed check form back that I could then take to the county clerk to finish up my permit changes. It has now been a month and I haven't heard anything. Did I misunderstand how this is supposed to work?

    No, you didn't. While the Monroe Clerk is awesome at speedy processing of amendments, they do not have electronic access to the NICS system and therefore they have to mail your Brady check paperwork into the FBI for approval. Could take up to a couple of months.

      This is a good reminder though, for those of us in Monroe county: If it has been 5 years (or close to five years) since your last Brady check with them, hit the clerks up and have them submit your paperwork so you can stay current and don't get jammed up like Warfab has. (I think it sucks that they don't have electronic access to NICS to do an instant one.)

        Am I correct in remembering that Monroe County is one of the few places that allow face to face transfers for CCW holders because of the 5 year Brady check?

          You are correct, providing both buyer and seller reside in Monroe county. Both parties show up at the clerk's office with a bill of sale, firearm is transferred between permits, deal is complete. FUAC!

          They are valid for 5 years according to MC clerk.

          **Please note that your Brady Check must be current prior to the addition of any firearm from an individual. This check must be completed once every 5 years and there is no cost to the permit holder. Please complete the Brady Check form and return it to our office for processing; you may not submit the form directly to law enforcement. You will receive the completed Brady check in the mail for your own personal records. Once you receive this paperwork, you will be allowed to add firearms from an individual.

            I was wondering about a time limit for their response. If a given amount of time goes by and I don't hear back I'm allowed to proceed with amending my permit? Probably wishful thinking, but having to wait indefinitely seems like a lawsuit someone would have tried already.

              Negatory. As far as I know, no amendment until results come back. It's not a case of the clerk getting a NICS delay, which would fall into the 3 day rule.....it's a case of bureaucratic paperwork moving at the speed of molasses. You're at the mercy of a non-electronic process.

                    Contrary to the requirements of the safe act, Monroe county allows a private sale between two residents to be completed at the clerk's office without an FFL (providing your Brady check is less than 5 years old). Suck it Andy!
