I guess it's worth repeating at this point.
DC v heller decision breaks down 2nd amendment line by line and explains it and says it's an individual right.
Chicago v mcdonald incorporates it federally and not just in DC.
DC v heller however did not talk about the shall not be infringed clause like it did the rest of the text. I think they said something about reasonable restrictions but they did not address specifically "shall not be infringed".
Now that that's out of the way we need to ask the important question. What does shall not be infringed mean? Shall not is pretty obvious in it's meaning but infringed could be a "wiggle" word like "reasonable" is.
Here is my take. The only legal definition I could find in past regarding the word "infringe" was found in patent law. Basically the example they gave was about a property owner. If your neighbor comes on your property and you don't say anything or take action against them then they aren't infringing your property. So if a company is using your patent without your permission and you do nothing then they aren't infringing on your patent.
So if we send letters or sign petition that we do not consent to any new laws that infringe on our INDIVIDUAL right to keep and bear arms and law passed would therefore be an infringement and unconstitutional.
I would also support this with the 10th amendment. Since the 2nd amendment is an INDIVIDUAL right AND it specifically has extra protection via shall not be infringed clause it is our right as the people to inform the government we don't consent to them violating our protected right and since it's an individual right out representatives do not have the authority to make those decisions for us, thus the law is unenforceable.www.AvidArms.com I'm STIHL out of conditioner!!
