SAFE Question

Somewhere I remember reading that if you legitimately thought your rifle was compliant, but you get busted with it and it's ruled non-compliant, you have a certain amount of time to rectify the situation. It's been so long since I've really looked into SAFE I can't remember where I read it. Does anyone remember if that's in the actual law or in the NYSP enforcement guidelines?

Anyone have the links handy so I can look it up again?

Cant find it now, but if I remember correctly that was from the same NYSP guideline that also created the "permanent" myth about the fixed mags.

A 30 day grace period stands out in my head too, but I don't remember ever seeing it in the actual bill.

A person who lawfully possessed the weapon prior to January 15, 2013, and knowingly fails to register by the aforementioned deadline may be charged with a class A misdemeanor. If the omission is an unknowing failure to validly register within the period the person is liable to a warning and may be given thirty days in which to apply to register or to surrender the weapon. See NY Penal Law § 400.00(16-c).

(c) A person who knowingly fails to apply to register such weapon, as required by this section, within one year of the effective date of the chapter of the laws of two thousand thirteen which added this paragraph shall be guilty of a class A misdemeanor and such person who unknowingly fails to validly register such weapon within such one year period shall be given a warning by an appropriate law enforcement authority about such failure and given thirty days in which to apply to register such weapon or to surrender it. A failure to apply or surrender such weapon within such thirty-day period shall result in such weapon being removed by an appropriate law enforcement authority and declared a nuisance. It's actually a bit more lenient than I thought. If you unknowingly failed to register you're given 30 days to apply to register or surrender it. I would have assumed that failure to register or surrender would give you at least the class A misdemeanor penalty, but instead the weapon will just be 'removed by an appropriate law enforcement authority'.

Granted, such removal could result in a dead dog and lots of damage to your house, but it's not the automatic felony I figured it would be.

Not true. There state left lots of grey areas in the law and refused to answer lots of questions posed by citizens. There's plenty of confusion even after 7 years.

Besides, what do you care as a Kentuckian?
