    ATF has reclassified bump stocks as "machine guns"......you have until March 2019 to turn them in or face Federal charges.

    It ain't gonna get no better going forward kids.......buy 'em up and stack 'em deep, they'll be coming for the rest of our PePeshittata sooner or later.

      My guess is this dies in court, but it's annoying that it's going to be a court battle at all. We've got better things to do with our time and money.

      I'm going to have to read up on exactly how the ATF is going to say bump stocks are machine guns. If the ATF is going to make the change by merely reinterpreting its own definition of machine gun, then I believe the upcoming SCOTUS case about Auer defense becomes directly relevant. Striking down Auer defense wouldn't immediately nullify a bump stock ban, but it would probably make defending an ATF bump stock ban in court rather difficult.

      No amnesty period like for the NFA. No compensation for the people who have them. No spike in violence like during the prohibition era. Tons of gun laws on the books.... the enforcment of which has been botched repeatedly in recent cases. The gun owning public is in a different mental state these days. Make enough things illegal and people are going to stop caring about the laws. I don't see people caring much about this.

        It sounds as though it's pretty much a done deal. Just like the unsafe act, it will go into effect and remain in effect while it's dragged out in court for the foreseeable future.

      You certainly are on top of things .I just read this and hour ago
      as I stated at lunch the NY Legistlature intends to ramp up gun prosecutions by reclassifying the supposed "crimes" by bumping up the Classification I.e. Class C violent felony just for possession

      ATF got over 35,000 comments during the comment period, went ahead and "reclassified" anyway (after ATF themselves emphatically stated in 2010 that it would "require congress to pass new legislation defining machine guns" in order for ATF to reclassify bump stocks).

            Under the NFA, the term "machinegun" means "any weapon which shoots, is designed to shoot, or can be readily restored to shoot, automatically more than one shot, without manual reloading, by a single function of the trigger." 26 U.S.C. 5845(b).
            This definition uses the key terms "single function of the trigger" and "automatically," but these terms are not defined in the statutory text.
            The NPRM proposed regulatory definitions for the statutory terms "single function of the trigger" and "automatically," and amendments of the regulatory definition of"machinegun" for purposes of clarity. Specifically, the NPRM proposed to amend the definitions of"machinegun" in§§ 478.11 and 479.11, define the term "single function of the trigger" to mean "single pull of the trigger," and define the term "automatically" to mean "as the result of a self-acting or self-regulating mechanism that allows the firing of multiple rounds through a single pull of the trigger."

            The Department, however, has revised the definition of"single function of the trigger" to mean "single pull of the trigger" and analogous motions, taking into account that there are other methods of initiating an automatic firing sequence that do not require a pull.
            Yup, the AG instead of the ATF:

            The Attorney General is responsible for enforcing the NF A, as amended, and the GCA, as amended.2 This responsibility includes the authority to promulgate regulations . necessary to enforce the provisions of the NFA and GCA. See 18 U.S.C. 926(a); 26 U.S.C. 7801(a)(2)(A), 7805(a). The Attorney General has delegated the responsibility for 2 NFA provisions still refer to the "Secretary of the Treasury." 26 U.S.C. ch. 53. However, the Homeland Security Act of 2002, Pub. L. 107-296, 116 Stat. 2135, transferred the functions of ATF from the Department of the Treasury to the Depattment of Justice, under the general authority ofthe Attorney General. 26 U.S.C. 780l(a)(2); 28 U.S.C. 599A(c)(I). Thus, for ease of reference, this notice refers to the Attomey General. 7 administering and enforcing the NFA and GCA to the Director of ATF, subject to the direction of the Attorney General and the Deputy Attorney General.
            So this isn't good, and the change of wording from "function" of the trigger" to "pull" of the trigger could easily be interpreted to outlaw more than just bump stocks. Rumor has it that a Geissele SD-3G trigger on an AR-10 will bump fire pretty easily. No springy stock necessary.

            But, for those who want to have their fun and throw a symbolic middle finger at the feds for this stupidity; a binary trigger fires once on the pull and once on the release. Since the wording is being changed to "pull", that seems like it wouldn't apply to what happens when you release the trigger. Maybe.

            Jerry Miculek has just been outlawed.

              In response to the NPRM, ATF received over 186,000 comments. Submissions came from individuals, including foreign nationals, lawyers, and government officials, as well as various interest groups. Overall, 119,264 comments expressed support for the proposed rule, 66,182 comments expressed opposition, and for 657 comments? the commenter's position could not be determined. The commenters' grounds for support and opposition, along with specific concerns and suggestions, are discussed below.
