    Murphy said he received more letters on Mokhiber's case than any other he's handled in 10 years on the bench. The judge said half of them assailed the SAFE Act, but the other half, which he found more important, talked about Mokhiber's personal qualities.

    Mokhiber, in addition to his 82nd Airborne service, served two years in the National Guard. After leaving the service, he worked in Iraq and Afghanistan as a private security officer protecting U.S. officials.

    After the sentencing, defense lawyer James M. Ostrowski vowed a thorough appeal.

    "We're going to take it all the way," Ostrowski said. "We'll look at every conceivable issue."

      I am just sifting thru this
      some points are not to clear
      refusing a breathalyzer will cause DMV to suspend your license, but in of itself is not an arrestable Offense
      in the 2 hours that you have to agree to the breath-a-lyzer you are ready in custody
      FST are meant to fail, and are not admissible in Court
      the proper route would be a Motion for Suppression as to the evidence is he was found not Guilty of DWI
      I need more intel

        Mokhiber was convicted, but sentenced to a conditional discharge at the judges discretion

        I have posted in the Devon Pratt thread as to how easy it is to get a conviction in strict liability cases

        there are issues before us here--
        1) them fukkers in Albany do not represent You, they represent "mob rule" known as "democracy"
        what happened to a constitutional republic " ..??

        2) Ostrowski loses every case, as an an attorney he can not make the arguments needed to win

        3) by his statements the defendant helped convict himself

              including the first which has no provision for Amendment
