NYC Changes Gun Control Laws In Fear of SCOTUS Review

Hopefully this is a case of "too little, too late" and we get a SCOTUS decision that mandates strict scrutiny in regards to any/all laws that even remotely infringe on the 2A. I'm thinking the fact that NYPD still requires weapons to be unloaded while being moved and the ammunition must be carried separately (that part of the rule will not change) is still a major infringement.

Licensed gun owners in New York City will soon be able to legally transport their firearm to a second home, business or any other place gun possession is permitted. These rules change were announced by NYPD Friday, 4/12/19, The changes are expected to go into effect after a 30-day public comment period starting next week.

“New York City has the toughest gun laws in the country, and this rule change will ultimately help protect these laws from being rolled back,” a city official said Friday.

Translation: "We'll just change the specific thing that the court has issue with so we don't have to throw the baby out with the bath water" FUNYC!!!!

I'm not sure how much judges communicate with each other and how much is just a rumor mill, but there seems to be a lot of government legal types acting like this case against NYC will be bad for gun control laws. I'm afraid all of the buildup is getting my expectations set way too high.

Yeah.....my fear is that SCOTUS will rule very narrowly on the specific sticking points of this case or worse yet throw it back to the lower courts with an order to re-evaluate the case based upon strict scrutiny thereby tying up any potential outcome for years into the future. I don't think this is going to be the new Heller or McDonald.

The good news is, no matter what the city does, there are exceptions to the mootness doctrine available to the Justices that allow them to hear the case even if the underlying law has changed. And such brazen attempts to sidestep a ruling the respondent wants to avoid tends to anger the nine robed ones.

if the fundamental law has been modified. And the nine robed ones usually become upset when a respondent makes such blatant tactics to escape a verdict.
