  • NYS Law and the Use of Deadly Force Class

    "NYS Law and the Use of Deadly Force", $50.00

    This class will be offered on October 15th by Nicys Firearms Instruction at Blue Mountain Sportsman Center in Cortlandt Manor, Westchester County.

    This is classroom only course, conducted by our attorney, No Live Fire or Ammunition

    Classroom: 1.5 hours, 9:00am to 10:30am

    I can't make it if anyone does I would be interested on take of this part. My guess is that depending on situation this could be a better defense then self defense depending on situation.

    Which is why ots probably a good idea to take this course!

A person in possession or control of, or licensed or privileged to be in, a dwelling or an occupied building, who reasonably believes that another person is committing or attempting to commit a burglary of such dwelling or building, may use deadly physical force upon such other person when he or she reasonably believes such to be necessary to prevent or terminate the commission or attempted commission of such burglary. ​​​​​

      Yeah, good luck with that one. Maybe that will fly in TX but wouldn't want to test it in NY. Just my personal opinion and this should not be considered legal advise.

        Of course, you still would have to argue you had no other way to stop the burglary and what not. Either way would be something I would like a lawyers take on.

          I'm guessing most lawyers would advise not shooting unless the perp is on top of you with a knife on the downswing towards your chest.

          Recoil Magazine is totally pro-gun and more serious about self defense than most gun publications, but even they ran a piece from a lawyer that was very opposed to trying to prevent a mass shooting. If anyone attends this class I'd be curious to hear a general synopsis of what is said.

            "WARFAB", the class is more about educating the participants on the laws of New York State, not much on legal advise since every situation will be unique.

            We talk about the before, during and after scenarios, what to expect, how to be prepared inside and outside your home to protect yourself and the family, we talk about situation awareness, avoidance, dealing w/ 911, the arrival of police, the psychological aspects of a deadly encounter, etc.

            All good stuff, I think well worth the $50.00 to seat down w/ a great attorney for about 1 1/2 hour.

              I have done this class 3 times and would do it 3 more times! In Saratoga County a attorney now has to do the article 35 portion of our unrestricted class. If you carry you should know this!!
