  • Getting your C&R

    Getting your C&R (FFL03) takes about 15 minutes of your time, costs $30 (for a three year license), and the BATFE turn-around seems to be @ 30 days. You don't need to get fingerprinted. You don't need to get references. You don't need to get anything notarized. You just need to fill out a quick form, write a check, buy a stamp, and stick the envelope in the mail box. Stop stalling....

    You guys that have been telling me for years "I gotta get my C&R one of these days" have no freaking excuse, now get to it before I buy up all the remaining surplus rifles on the market!

          Precisely. I have INTENTIONALLY not filled out the paperwork to avoid divorce and bankruptcy. LOL.

                  But it also just gives me more questions. I saw listed Mosin Barreled actions that said they ship to C&R holders, but if I put it in a aftermarket stock is isn't no longer C&R?

                  If I want to give my dad a gun and its on my log book do I have to go through a real FFL and do a transfer even though he is immediate family?

                    About the barreled action question, technically they are not C&R (as per ATF Ruling 85-10) and must be shipped to an 01 FFL. Anybody receiving one on their C&R is taking a big risk (I don't care that the seller has them advertised as C&R OK). Swapping out to a plastic stock changes the status and rifle is no longer C&R, how one would deal with the legalities of such a situation is a big clusterfluk I would imagine:

                    The definition for curio or relic (“C & R”) firearms found in 18 U.S.C. 27 CFR § 478.11 does not specifically state that a firearm must be in its original condition to be classified as a C&R firearm. However, ATF Ruling 85-10, which discusses the importation of military C&R firearms, notes that they must be in original configuration and adds that a receiver is not a C&R item. Combining this ruling and the definition of C&R firearms, the Firearms Technology Branch (FTB) has concluded that a firearm must be in its original condition to be considered a C&R weapon.
                    It is also the opinion of FTB, however, that a minor change such as the addition of scope mounts, non-original sights, or sling swivels would not remove a firearm from its original condition. Moreover, we have determined that replacing particular firearms parts with new parts that are made to the original design would also be acceptable-for example, replacing a cracked M1 Grand stock with a new wooden stock of the same design, but replacing the original firearm stock with a plastic stock would change its classification as a C&R item.



                    As to the second question: BATFE does not require a BG check for C&R to buy from private individuals nor to sell to private individuals. In addition, NYunfukingsafe exempts BG requirement between son and father so you're good to give Dad a C&R gun

                    Are transfers of curio or relic firearms by licensed collectors subject to the NICS background check requirements? No. However, it is unlawful for any person to transfer a firearm to any person knowing or having reasonable cause to believe that such person is a felon or is within any other category of person prohibited from receiving or possessing firearms.

                    Are licensed collectors required to execute an ATF Form 4473 for transactions in curio or relic firearms?
                    No. However, licensed collectors are required to keep an acquisition and disposition (A&D) record.

                        NY Safe has not affected C&R at all, except for the CMP and one guy here in NY that refused to sell me a C&R rifle without going through an FFL BG check (even thought the NYSP said it was OK). C&R is an FFL so rifles are delivered right to your door! FUAC.

                            OK .... so I let my C&R run out (2013). What do I have to do to get it again?? All of the running around that I had to do last time?? What a PITA that was. I only bought one damn gun on my last FFL 03 and just want it to have it incase I ever start collecting .... again. I found that 01FFL's won't sell to me on my 03FFL so ... I never got to use it other than the one gun. I want to make this 100% clear to all of you that have a 03FFL now. IF you purchase a C&R eligible firearm from a dealer OR you buy one from an individual that insists on you having a NICS BGC done on you at time of purchase, that firearm IS NOT to go on your books!!! I specifically asked this question at least 20 times and every time I was told that since you had the BGC on you, that is now on the 01FFL's books and there that firearm is NOT to be entered into your own books. Why you ask?? Because by you having the BGC performed, you did NOT use your 03FFL and as such, that firearm is NOT to be entered. Only firearms you purchase for your collection where you become the entity in the transaction by using your 03FFL are to be entered on the books. All others I mentioned prior become personal firearms and ARE NOT considered part of your collection.
