    There's a lot to unpack in that article, and I'm sure there will be unintended consequences of these changes.

    Long gone are the days when a sympathetic judge could do an impoverished person a favor by incarcerating them for 90 days in the cold winter months. For that same person to get “three hots and cot” the down-state liberals hope the soon-to-be-empty correctional facility might better be turned into a homeless shelter. This is not an exaggeration. Washington County, NY has implemented only some of these new criminal justice reforms and their jail population has shrunk by 50%.
    Aside from providing shelter for certain homeless people, there is also the issue of the jails and prisons handling people with mental health problems. Putting all these people out on the street is sure to create additional problems for a variety of citizens, businesses, and institutions.

    Naturally if violent crimes become more common, these policy changes won't be blamed. Instead we'll probably get more gun control laws restricting the ability of law abiding citizens to protect themselves from all the criminals not being jailed.

    Makes me want to puke. The LEO's I know refer to this as the "catch-and-release" law because it basically means everybody they arrest (short of serial murders) will be released within a few hours of being booked.....no more cooling their heels in jail. Have you seen the list of crimes that now require an appearance ticket only and do not provide for pretrial detention?

    Child pron, criminal possession of a firearm, assault, manslaughter, arson, aggravated assault upon a person less than eleven years old(!), etc. Sweet Jesus......

    • Manslaughter in the second degree

    • Specified felony drug offenses involving the use of children, including the use of a child to commit a controlled substance offense and criminal sale of a controlled substance to a child
    • Criminal solicitation in the first degree and criminal facilitation in the first degree
    • Money laundering in support of terrorism in the third and fourth degree
    • Making a terroristic threat
    • Patronizing a person for prostitution in a school zone
    • Promoting an obscene sexual performance by a child
    • Possessing an obscene sexual performance by a child
    • Promoting a sexual performance by a child
    • Failure to register as a sex offender
    • Obstructing governmental administration in the first and second degree
    • Obstructing governmental administration by means of a self-defense spray device
    • Bribery in the first degree
    • Bribe giving for public office
    • Bribe receiving in the first degree
    • Promoting prison contraband in the first and second degree
    • Resisting arrest
    • Hindering prosecution
    • Tampering with a juror and tampering with physical evidence
    • Aggravated harassment in the first degree
    • Directing a laser at an aircraft in the first degree
    • Criminal possession of a weapon in the fourth degree
    • Criminal sale of a firearm to a minor
    • Enterprise corruption and money laundering in the first degree
    • Aggravated cruelty to animals, overdriving, torturing and injuring animals
    • Failure to provide proper sustenance
    • Animal fighting

      Both of the sheriff's deputies I've asked have said "yeah, it's actually that bad".

      The one deputy predicts the larger counties like Monroe, Erie, and Onandaga are going to have serious issues. Not encouraging.

        Looks like thughes might be getting out of dodge just as things completely fall apart. Along with letting all kinds of criminals out of the lockup to freely roam the streets while awaiting trial, the city of Rochester also approved the "Police Accountability Board" with 75% of the vote.

        Should be a nice little social experiment that has serious real life consequences for lots of people.

            Typical NY: Pass something...anything...and then fix it later when we realize we f ucked up.

            With a rise in anti-Semitic hate crimes over the holiday, some Democrats are now rethinking the sweeping bail reform passed by both houses of the state legislature last year.

            "There is a chance now for the legislature to get it right," de Blasio said. They did some very good reforms, but there are also things that need to be done, particularly empowering judges to determine if someone poses a threat to the surrounding community."


            Another case of 3 men in a room making law without any public input or review:

                    LIVONIA — Livingston County Sheriff Thomas J. Dougherty on Friday reported the arrest of a Livonia resident on numerous charges, including felony weapons charges, after an investigation by the Sheriff’s Office.

                    On Jan. 17 at approximately 2:30 a.m., Sheriff’s Deputies responded to an address on East Lake Road in the Town of Livonia after a male called the Livingston County Emergency Communications Center reporting that he had just been shot in the foot by his neighbor.

                    The investigation by members of the Sheriff’s Office revealed that the victim was visiting his neighbor, 41-year-old Justin D. Mckinney. It is alleged that Mckinney became upset that the victim would not leave his residence and physically pushed him out the front door. After Mckinney and the victim were outside the residence, Mckinney fired a round from a 9mm pistol in the direction of the victim which struck the victim in the foot. The investigation further revealed that Mckinney did not have a license to possess a pistol.

                    The victim was transported to Noyes Memorial Hospital by Livonia Ambulance for treatment of non-life threatening injuries.

                    Sheriff’s Investigators arrested and charged Mckinney with felony second-degree Criminal Possession of a Weapon, felony second-degree Criminal Use of a Firearm, felony first-degree Reckless Endangerment, third-degree Assault, and two counts of Endangering the Welfare of a Child as there were two young children home at the time.




                    Mckinney was turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention. The District Attorney’s Office was contacted in regards to bail due to the felony level charges and the fact that the charges did qualify for arraignment and the potential for bail to be set under the new NYS Justice Reform Act. It was recommended that Mckinney be held on $2,000 cash bail or $4,000 bond.

                    Mckinney was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Livonia Justice Robert Lemen. The Judge did remand Mckinney to the custody of the Sheriff on $1,000 cash bail or $2,000 bond. Conducting the investigation for the Sheriff’s Office were Captain Brian Applin, Investigator Brad Schneider, Investigator Michael Williams of the Criminal Investigations Division; Sergeant Joseph Zambito and Sergeant Matt Moran of the Patrol Division; and Deputy Caleb Cutting of the Forensic Identification Unit (FIU).

                    Child Protective Services was also contacted regarding the incident.

                      What am I missing? His crimes were severe enough to warrant bail under the new reforms so the judge set bail. Is the interesting part that I can commit felony gun crimes and get back on the street for just a couple grand?
