    Don't forget to pay attention in the workplace. Do you have covid policies that aren't being enforced? Document it, if you get fired point out the inconsistent enforcement of policy.

      Move to TX:

      "Texas Gov. Greg Abbott issued an executive order Monday to prohibit any entity, including private business, from enforcing a COVID-19 vaccine mandate on workers and called on state lawmakers to pass a similar ban into law."

      "Abbott previously barred vaccine mandates by state and local government agencies, but until now had let private companies make their own rules for their workers."

        guess there has been talk at the partner level at my office that they'll eventually have to mandate it here. we are well under 100 employees but the lion share of our work is in schools, and schools are requiring it. they haven't announced anything yet but it sounds like they might here soon.
        who knows, because they aren't good at coming up with policies, they usually avoid it if they can. for instance our work from home policy is really not to have a policy

        should get interesting because i'm not the only one anti-mandate here and we are certainly in an architects shortage here too (not just our firm, but in town)

          If you have time look up Thomas v. Review Bd. of Ind. Employment Se-
          curity Div., 450 U. S. 707, 714 (1981).

          Precedent for unemployment benefits. Basically jahovis witness asked to be fired because he couldn't work on weapons for religious reasons. They denied his request to he quit. They denied him unemployment and the supreme court decided his religious freedom was violated and entitled to unemployment. Another interesting point is that another person in same religion had no issue doing the work. Again it's a personal thing and it doesn't matter what others of your own faith think.

            A: Biden is admitting the vaccine requirements from his September 9th executive order are not yet implemented, with no real timeline in this speech, just assurance that it will be implemented "soon". Will it? How soon? Why does it take over a month?

            B: The FDA and CDC have not yet made the determination on whether the vaccine should be approved for kids ages 5-11, but the government has already purchase the vaccine doses for this age group....?!?! So either the government is just giving billions of dollars to the drug companies for nothing, or they're going to push the vaccine approval for kids regardless of what the FDA and CDC actually think. Either way, that's a hard no from me. Anyone tries to jab my kids and it will be the last thing they do. Mandate it for school and we'll either make the comittment to homeschool or move to a free state pronto.

            So I have another question about the mandates and the way medical and religious exemptions are being handled. I thought that medical and religious accomodations need to be handled the same way for everyone.

            So why do we have a different process for the vaccine exemptions then any other exemption? Specifically why isn't there (assuming there isn't) forms for any other possible accomodation people need?

            It seems like these accomodations have a different level of scrutiny then accomodations in the past. If that's the case then wouldn't that potentially be violating the first amendment rights of employees? Doesn't seem like a fair process either if you have read any of the forms companies have come out with.

            The forms I've read so far phrase the questions in a way that most people wouldn't qualify or make it easier for employer to deny requests. They are asking for information not required by law to be given and in some circumstances asking for supporting clergy letters in initial request which again the law does not require. Someone with a personal relationship with God may not have clergy and they don't have to for protections. The form for my sister's employer says you have to submit letter from clergy or request won't be considered complete and won't be reviewed.

              There are a lot of reference cases on the books where religious accommodations were made for people who didn't want to get the flu vaccine despite their employer requiring it. Religious exemptions have been ruled upon in a very broad manner basically stating anyone's deeply held personal beliefs should be accommodated. If her employer is demanding a letter from a member of the clergy, I'd suggest she look into finding a lawyer. I don't know of the resources to find the right type of lawyer, but it seems like to the right type of lawyer these cases would be money in the bank.

                She's vaccinated but showed me the form her employer had that was obviously a violation of law. Every form I have seen has asked for the reason why someone's faith prevents them from vaccination. It's written in a way where I think people are expected to argue against all vaccines. But the fact is they you only need to articulate why it's against your religious beliefs for the covid vaccine.

                      I asked my HR department when I could submit my religious accomodation letter and was told they are still figuring things out and they would let company know when they have a process in place.

                      Again shouldn't every employer already have a process in place to handle medical and religious accomodation requests?

                      ETA: I thought the interactive process was supposed to start as soon as the employer is made aware of the need for accomodation?

                            Interesting that the "theme" of the booster shot meetings has been balance between rigorous scientific evidence and real world urgency is a thing.

                            After all this has been about no special treatment and these vaccines being out through the same process as anything else and held to the same standards.

                            If that's true then I now question the ability of FDA and CDC to do the job they want the public to believe they do. The FDA and CDC has been wrong on all 3 vaccines! None provided immunity, none WERE actually vaccines by definition so they had to change the definition.
