    Two months ago, the Department of Justice quietly offered Wilson a settlement to end a lawsuit he and a group of co-plaintiffs have pursued since 2015 against the United States government. Wilson and his team of lawyers focused their legal argument on a free speech claim: They pointed out that by forbidding Wilson from posting his 3-D-printable data, the State Department was not only violating his right to bear arms but his right to freely share information. By blurring the line between a gun and a digital file, Wilson had also successfully blurred the lines between the Second Amendment and the First.

    "If code is speech, the constitutional contradictions are evident," Wilson explained to WIRED when he first launched the lawsuit in 2015. "So what if this code is a gun?”
    "I consider it a truly grand thing," Wilson says. "It will be an irrevocable part of political life that guns are downloadable, and we helped to do that."

    Now Wilson is making up for lost time. Later this month, he and the nonprofit he founded, Defense Distributed, are relaunching their website Defcad.com as a repository of firearm blueprints they've been privately creating and collecting, from the original one-shot 3-D-printable pistol he fired in 2013 to AR-15 frames and more exotic DIY semi-automatic weapons. The relaunched site will be open to user contributions, too; Wilson hopes it will soon serve as a searchable, user-generated database of practically any firearm imaginable.
    It will be interesting to see how this impacts the gun industry long term. It seems like it might push more innovation in gun design.

    Significantly, the government expressly acknowledges that non-automatic firearms up to .50-caliber – including modern semi-auto sporting rifles such as the popular AR-15 and similar firearms – are not inherently military.

    "Not only is this a First Amendment victory for free speech, it also is a devastating blow to the gun prohibition lobby," noted SAF founder and Executive Vice President Alan M. Gottlieb.       According to the press release from the Second Amendment Foundation, the “government expressly acknowledges that non-automatic firearms up to .50-caliber – including modern semi-auto sporting rifles such as the popular AR-15 and similar firearms – are not inherently military.”

      This sounds great, but the devil is in the details of the new rule.

      First, this settlement agreement is not the same as the final regulation. The settlement may be helpful in another, future lawsuit, but this settlement cannot bind the outcome of the final regulation. Furthermore, the final regulation may not even mention the settlement’s definition of “Military Equipment.” It is important that the State Department cement this distinction in a binding government document, like the pending new rule.

      Second, the State Department only promised a process to address the regulation. That process may be favorable to gun owners or it may be so narrow as to barely affect our purchase and ownership of firearms and the designs to make them.

      The State Department will first publish a Notice of Proposed Rulemaking (NPRM) that will detail the potential new regulation exempting certain firearm designs intended for sharing. The NPRM will also detail the time period for the public to submit comments on the proposal in support or opposition.

      This is a critical phase of the notice-and-comment process. After the comment period, the State Department may receive so much negative feedback on its proposal that it determines it should craft something much more restrictive of gun rights.

        A few states are trying to get DefCad to not proceed with publishing the files. It sounds like PA, New Jersey, and Los Angeles. DefCad filed lawsuits in response.

        I have no idea how this will play out from a legal standpoint, but from a practical standpoint, these politicians couldn't look like bigger idiots. It would be kind of comical if it weren't for the fact that they were wasting taxpayer money to pull this garbage. Aside from the futility of trying to stop files from circulating on the internet based upon geographical boundaries, there are also multiple other websites where such files already exist and nobody has ever said anything about it. DefCad is the site making the noise and getting the attention, but hardly the only place someone can find all the files necessary to start milling some firearms. Then there's also the minor issue of 80% receivers being readily available and a much easier way to build a firearm than starting from scratch with just the CAD files.

            Cuomo Issues Cease and Desist to 3-D Printed Gun File Distributor

            Gov. Andrew Cuomo issued a cease and desist letter on Tuesday to block residents in New York from downloading files that could be used to create guns with a 3-D printer.




            The action, Cuomo said, would prevent any internet user with an IP address from New York from accessing files shared by Defense Distributed, a private defense firm in Texas. The firm plans to release files for public download Wednesday that would allow users with a 3-D printer to create and manufacture guns.

            “The last thing we need now are people making guns in their own home that circumvent all laws, are untraceable, and are invisible,” Cuomo said on a conference call with reporters.




            Cuomo’s announcement came after a coalition of state attorneys general, including New York’s Barbara Underwood, filed a lawsuit on Monday to permanently stop the files from Defense Distributed from being shared nationwide.

            A federal judge is expected to consider a temporary restraining order later Tuesday to temporarily block Defense Distributed from distributing those files. Cuomo’s letter will only be needed if the judge denies the temporary restraining order.

            Cuomo said if Defense Distributed does not comply with the cease and desist letter, the state would bring an additional legal action against the company to enforce compliance with the state’s gun laws, which are among the strictest in the country. The company did not respond to an inquiry about Cuomo’s letter.




            “If a state chooses to allow this product to be distributed, I think they’re making a mistake,” Cuomo said. “That’s their business, but not in the state of New York.”

            Cuomo is also seeking information from Defense Distributed on New York residents who have already downloaded plans to 3-D print a gun. Some users have already been able to download files from the company.

            Information on those users allows the state to identify people who may have plans to print a gun that violate the state’s gun laws. One file, for example, allows a user to 3-D print an AR-15, a gun that is banned in New York state.

            “We’re seeking information from the company, because the company knows who’s acquired their product,” Cuomo said.

            He’s also directed State Police Superintendent George Beach to remind residents that certain guns and features are banned under state law, regardless of whether they are available as a file to be 3-D printed.

            Cuomo said he’s planning state legislation to regulate firearms that have been 3-D printed. State Sens. Brad Hoylman and Kevin Parker, both Democrats from New York City, have already announced a bill that would regulate those firearms.

            Their legislation would require an individual to have a gunsmith license to manufacture or assemble a gun that’s been printed. That individual would also have to register the gun with law enforcement and attach a serial number to the firearm. Those guns would be illegal to buy or sell without a serial number in New York. The bill would also require that each piece of a printed gun be detectable by a metal detector.

            A press release from Cuomo’s office did not mention the bill, but his proposed legislation appears to include the same provisions.

                A federal judge in Seattle issued a restraining order Tuesday afternoon temporarily stopping the release of blueprints to make untraceable and undetectable 3D-printed plastic guns.

                U.S. District Judge Robert Lasnik issued the order a day after eight states sued the government to block a settlement reached by the Trump administration last month allowing a Texas-based company, Defense Distributed, to resume online-sharing of blueprints for the 3D firearms.

                The company was set to allow downloads on Wednesday, although blueprints have been posted since Friday. The temporary restraining order blocks the release until the next scheduled hearing on August 10.


                The amount of idiocy being parroted by the media and morons on social media over this story is ridiculous.

                        Cody Wilson, an Austin man whose fight over 3D-printed guns thrust him into the national spotlight, faces a charge of sexual assault, according to an arrest affidavit filed in Travis County district court on Wednesday.

                        The affidavit said a counselor called Austin police on Aug. 22 to report that a girl under the age of 17 told her she had sex with a 30-year-old man on Aug. 15 and was paid $500.



                        The girl told police that she met Wilson at Bennu Coffee in the 500 block of South Congress Avenue in South Austin on Aug. 15 before they took Wilson’s black 2015 Ford Edge to the Archer Hotel in the 3100 block of Palm Way.

                        Detectives used surveillance footage to corroborate the girl’s story, along with hotel records that showed Wilson rented a room at the hotel, the affidavit said.

                        The girl told police she and Wilson had sex at the hotel and that he paid her $500.

                        The pair left the hotel around 9:20 p.m. before Wilson dropped the girl off at a Whataburger on Slaughter Lane, the affidavit said.

                            UPDATE: According to mysanantonio.com, Cody Wilson has flown to Taiwan.
                            “Before he left, he was informed by a friend of the victim that she had spoken to police, and police were investigating him for having sex with a minor,” said Austin Police Commander Troy Officer.

                            Officer said it was unclear when Wilson left for Taiwan, or why exactly he went there, but he didn’t board a return flight to the United States.

                            Austin police are now working with international law enforcement agencies to extradite Wilson back to Travis County for prosecution.


                            Perhaps he could get legal defense tips from Leticia Astacio.
