  • California Judge Strikes Down Magazine Ban

A Californian judge struck down the "high capacity" magazine ban because it amounts to confiscation without reimbursement. It's official New Yorkistan sucks.

A federal judge on Thursday blocked a California law set to take effect Saturday that would have barred gun owners from possessing high-capacity ammunition magazines.

The judge ruled that the ban approved by the Legislature and voters last year takes away gun owners' Second Amendment rights and amounts to the government taking people's private property without compensation.

California law has prohibited buying or selling the magazines since 2000, but until now allowed those who had them to keep them.

"Hundreds of thousands, if not millions, of otherwise law-abiding citizens will have an untenable choice: become an outlaw or dispossess one's self of lawfully acquired property," San Diego-based U.S. District Judge Roger Benitez wrote.

He issued a preliminary injunction blocking the law from taking effect while he considers the underlying lawsuit filed by the National Rifle Association-affiliated California Rifle & Pistol Association.

I have really started to hate the term "high capacity" How about we call it "arbitrarily restricted" instead.

I know a lot of people are adamant they be referred to as standard capacity. That's why I put "high capacity" in quotes.

"Arbitrarily Restricted" does a nice job of playing off judge Skretny's decision.

I read two justifies wanted to take up 2a cases. Once the appeal is served the USSC MIGHT take this up on the 2018 docket I would assume.

C'mon. You came up with an ingenious way to discuss the debate over magazine capacity and now you're going all negative on me?

According to anti gunners, AR stands for assault rifle. If ARM became a well known acronym, it would be an easy way to include magazines in the second amendment.

The left loves playing tricks with language to control narratives. Why can't we?
